Valid for modules dispatched from Suntech’s factories between 1 January and 31 December 2010.

Warranty Start Date

The earlier of:

1. date of sale to 1st customer; and
2. 12 months after module dispatch from Suntech Power factory

Warranty claims must be received by Suntech within the warranty period.

Product Warranty

Product warranted for 5 years from the Warranty Start Date as being free from defect in materials and workmanship under normal application, installation, use and service conditions.

Product Liability

Suntech will, at its option, repair or replace the product, or refund the then current market price of the modules.

Performance Warranty

Power output less than:

• 95% – 5 years
• 90% – 12 years
• 85% – 18 years
• 80% – 25 years

provided that such loss in power is determined by Suntech (at its discretion) to be due to defects in material or workmanship. Percentages refer to the nominal power as set out in Suntech Power’s product datasheet

Performance Liability

Suntech will, at its option, provide additional modules to the customer to make up for loss in power, replace the defective modules, or refund the proportionate cost of the module (as measured by the then current market price) representing the shortfall below the specified percentages.

Exclusions and Limitations

Warranties do not apply to modules which have been subjected to:

1. misuse, abuse, neglect or accident;
2. alteration, improper installation or application;
3. non-observance of installation and maintenance instructions;
4. unauthorised repair or modifications;
5. events outside Suntech’s control;
6. alteration, removal or tampering of the serial number.

Warranties do not cover costs associated with installation, removal or re-installation of the PV-modules and customs clearance or other costs for return of the modules. Warranties do not apply to modules marked as “Grade A” or “Grade B”. The warranty is only transferable when the product remains installed in its original installation location.

Service

Customer must send immediate written notification to Wuxi Suntech Power Co., Ltd, either by registered mail to 9 Xinhua Road, Wuxi New District, China 214028 or by email to services@suntech-power.com, ..enclosing evidence of claim (including copy of detailed Suntech invoice), serial number and date of purchase.
